Jos. Maurice Filiatrea 2 CONC u claimed that Rucker never spanked him or had a cross word for him. Rucker bought his far 2 CONC m from his father in law, Blandford. Apparently, Rucker was an astute businessman, and was f 2 CONC airly well off. He helped people out financially during the depression. 2 CONT Rucker and his wife Josie were both very religious Catholics. 2 CONT According to Maurice Filiatreau, during the Civil War, Rucker was held down by a Confederat 2 CONC e Soldier at one point. He was unsure whether the soldier would run him through with his bay 2 CONC onette or not. 2 CONT 2 CONT Apparently, the Filiatreaus drank alcohol liberally. 2 CONT 2 CONT According to Maurice, the Filiatreaus were fairly egalitarian in regard to African Americans 2 CONC . At one point in the interview, Arthur Kelly asked him if any black folks helped Josie arou 2 CONC nd the house during her illness. Maurice corrected him and said the neighbors, black and whi 2 CONC te, helped out. 2 CONT Later, he also stated that they when he was young, they would go to dances in peoples' parlor 2 CONC s. Filiatreau 4 CONT 4 CONT Legend has it that Isaac Nazarre Filiatreau, the first of his surname to settle in Washingto 4 CONC n County, had been "stolen" as a child and packed off to Kentucky from Quebec. This romanti 4 CONC c tale has not been substantiated, but the little that is known about "Nazarre" (or Nazaire 4 CONC " or Nazarie") suggests that it is plausible. He told census officials he was born in Canad 4 CONC a on March 20, 1809. He told his children that their forebears had crossed the water from Al 4 CONC sace, France. His 1840 marriage, in Washington County, apparently was the first occasion t 4 CONC o warrant the recording of his name. 4 CONT Nazarre married Belinda Hayes (Brent), the daughter of John and Dina Hayes; she was 28 year 4 CONC s old and had a son, John Brent, b y a previous (1830) marriage to John G. Brent. She and Na 4 CONC zarre had seven children: William Thomas, born in 1841, Columbus Rucker (1842), Robert Peyto 4 CONC n (1844), Anna Jane (1846), Isabel (1848), Nazariah Augustine ("Nat") (1849) and James Frankl 4 CONC in Pierce (1853-the year Franklin Pierce became the nation's 14th president, presumably wit 4 CONC h Nazarre's backing). 4 CONT Some records refer to Nazarre's wife as "Malinda". Curiously, both names-Belinda and Malind 4 CONC a-reappear among the names given to the children of Columbus Rucker Filiatreau. 4 CONT Nazarre died on Dec. 30, 1898, at age 90, and was buried in St. Rose Cemetery. 4 CONT Two of his sons, Columbus Rucker ("Ruck") and William Thomas ("Bill"), joined the Union Arm 4 CONC y together in 1861. Bill was soon discharged because of illness, but Ruck saw action in a ho 4 CONC st of civil War battles. 4 CONT Early in the war, his Company K of the Tenth Kentucky Volunteer Infantry chased John Hunt Mo 4 CONC rgan away from the L&N Railroad. During its three-year existence, the Tenth Volunteers saw a 4 CONC ction at Mission Ridge, Jonesboro, Corinth, Rolling Fork, Hoover's Gap, Fairfield, Tullahoma 4 CONC , Compton's Creek, Rocky Face Ridge, Resaca, Chattahoochie River, Vining's Station, Pickett' 4 CONC s Mills, Courtland, Perryville, Lookout Mountain, Bunker Hill, Mills Spring, Little Gettysbur 4 CONC g, and Chickamauga; some units marched across Georgia with Gen. William Sherman. Of the 99 m 4 CONC en who joined Company K with the Filiatreau brothers, seven were killed in action and nine ot 4 CONC hers died while in uniform. 4 CONT Ruck, a battlefield nurse who drove a horse-drawn ambulance, was shot in the heel at Perryvi 4 CONC lle. He won several decorations and was discharged as a vice corporal in 1864. 4 CONT Ironically, when he died nearly 70 years later, the cause of death was a foot infection. I 4 CONC f it had to do with his old heel wound (one source has it that the fatal infection started i 4 CONC n a toe), he may have been the last casualty of the Civil War. 4 CONT Only a few stories of the War have survived in family lore: How Ruck and a handful of comrad 4 CONC es saved themselves hiding in the corn shocks while Morgan's cavalrymen passed so close by th 4 CONC ey could have reached out and patted their horses; how they slept on bar ground and often awo 4 CONC ke to find their hair frozen to the mud; how they cheated starvation by living on kernels o 4 CONC f corn picked out of horse manure. 4 CONT Ruck was born on June 7, August 4 or August 7, 1842, in the Manton section of Washington Cou 4 CONC nty. IN 1873, he married Josepha Alemany "Josie" Blandford, the seventh child of Thomas R. a 4 CONC nd Susan Caroline (Tennelly) Blandford. 4 CONT The record tells only that Josie was born on Jan.13, 1850, bore 10 children and died in 1916 4 CONC , of tuberculosis. Of the record, she is said to have been worm, wise, generous and resource 4 CONC ful. Her name evokes reverence in the family even today, 75 years after her death. 4 CONT (Ruck's brother Nat married Frances Blandford, Josie's sister. By the time of the 1870 Cens 4 CONC us, their older brother Bill had married a woman identified only as "Sary" and had fathered t 4 CONC wo daughters. The record is silent on the others.) 4 CONT Ruck prospered as a blacksmith, mule breeder and land trader in the years after the Civil Wa 4 CONC r. When he died, at age 90, he left each of his surviving three sons and six daughters a pri 4 CONC ncely sum - almost $10,000. 4 CONT One of his sons, Francis Xavier ("Zave") Filiatreau, had borrowed against and spent the bul 4 CONC k of his inheritance - about $7,000 of it - by the time of his father's death. He wasted lit 4 CONC tle time squandering the rest on a resort hotel in New Hope, whose future as a tourist trap h 4 CONC e had overestimated (to the unending displeasure of his humorless wife, the former Ida Mae Co 4 CONC tton). Eventually Zave moved his family to Louisville. 4 CONT Ruck's oldest son, Joseph Maurice, stayed at home, farming the family land on the banks of t 4 CONC he Beech Fork River not far from the Burg. "Maurice" and his wife, the former Fannie Logsdon 4 CONC , lived in a hilltop home that burned down after a gas explosion two decades ago. Their gran 4 CONC dchildren farm the land today. 4 CONT The third son, Raymond Nazarre, trained as a podiatrist, served in the Army Medical Corps du 4 CONC ring World War I and eventually resettled in Elwood Ind. 4 CONT Two daughters joined the Dominican religious order. Presumably Ida Etta was happy to be ren 4 CONC amed Laurentia, while Caroline Belinda ("Caralinda") may have been less happy to become Rose 4 CONC , since she had a sister named Rose. 4 CONT The other sister (not Sister) Rose (actually Rosaline) married Lee Willett and lived in an 4 CONC d around the Burg (Fredericktown). Nancy Malinda ("Aunt Nancy"), blinded in her youth by a m 4 CONC edication used to treat an eye infection, never married; she used her inheritance to live i 4 CONC n relative independence in various Catholic institutions. Mary Joseph ("Mary Jo") married Be 4 CONC nedict Clements of Lebanon. A seventh sister died just three days after her birth, to agin 4 CONC g parents, in 1895; she was given a touching, powerful name: Josie Rucker. 4 CONT Ruck died on June 2, 1933, at a relative's home in Louisville. The Springfield Sun said he d 4 CONC ied of "complications following a foot infection, with which he was stricken in October of la 4 CONC st year." You wanted t 4 CONC o know what part of the line our regiment was in. I belonged to the 10th Ky inf 14th army cor 4 CONC ps comanded by Gen G. H. Thomas. We always called him Pap (Pop?) Thomas. I remember Rossvill 4 CONC e and Ringold. We camped at Ringold a few days after the Battle at James borough below Atlan 4 CONC ta. Our term of service had expired was sent back to Ringold to guard the place. Whilst ther 4 CONC e it was reported we was ordered to pack and we marched to Chatanooga that night and marche 4 CONC d back the next morning. So it was a false report. I don't know who comanded our Division a 4 CONC t that time. Our Brigade was composed of the following regiments: the 10th Ind the 74th Ind 1 4 CONC 4 Ohio & 4th Ky & the 10th Ky. I dont recolect the names of the fields and woods we fought o 4 CONC ver but I know we were first going forward and then back for the two days. I know we layed a 4 CONC t the chick(?) Springs the night after the first days battle and the next night fell back t 4 CONC o Chattanoga and staid there for about 2 mo and liked to have starved. The enymy had our gru 4 CONC b line cut off. Sherman came to our asisstance and we marched out up mission Ridge & Lookou 4 CONC t Mountain and cleaned the [Reb?] off and after that we got plinty of grub. The ballance o 4 CONC f the war Sherman took comand of the army and kept everything going and coming. I guess thi 4 CONC s will give you some idea of where we was. He loved to play pranks. He was a guard a 2 CONC t a distillery. 2 CONT Mary had to stay with Zave and Ida after Ida fell and broke her hip. This was an experience t 2 CONC hat would try the patience of Zave and Mary. Ida was very demanding. Mary got very little t 2 CONC o eat because Ida always had to know what she was doing. 2 CONT During that time, Zave was in charge of cooking. He would cook a ham on Sunday, and they wou 2 CONC ld eat that ham during the week until it was just about gone. Then they would eat ham salad 2 CONC . Mary got really sick of ham during that time. 2 CONT 2 CONT For years, Zave had a dirty joke that he wanted to tell to Libby Clark. Every time he starte 2 CONC d to tell her, Ida would yell at him, and he would shut up. When Ida died, Zave told his dir 2 CONC ty joke to Libby Clark at the funeral home. Libby told Mary Filiatreau that the joke was REA 2 CONC LLY dirty! Neither Zave nor Libby told the joke to Mary. It was probably too dirty for her. 2 CONT 2 CONT Joseph Maurice Filiatreau didn't speak very enthusiastically about Zave. He said that Zave w 2 CONC as a good worker until he got to be about 18 years old, then he slowed down. He moved to Lou 2 CONC isville and never did any good there. He may have reflected some disappointment Rucker may ha 2 CONC ve had with Zave. In the first codicil to Rucker's will, he changed the executor from Raymon 2 CONC d, Zave and Maurice Filiatreau to just Maurice alone. He was a blacksmith. Filiatreau 4 CONT 4 CONT Legend has it that Isaac Nazarre Filiatreau, the first of his surname to settle in Washingto 4 CONC n County, had been "stolen" as a child and packed off to Kentucky from Quebec. This romanti 4 CONC c tale has not been substantiated, but the little that is known about "Nazarre" (or Nazaire 4 CONC " or Nazarie") suggests that it is plausible. He told census officials he was born in Canad 4 CONC a on March 20, 1809. He told his children that their forebears had crossed the water from Al 4 CONC sace, France. "Maurice" and his wife, the former Fannie Logsdon 4 CONC , lived in a hilltop home that burned down after a gas explosion two decades ago. A seventh sister died just three days after her birt 4 CONC h, to aging parents, in 1895; she was given a touching, powerful name: Josie Rucker. 4 CONT Ruck died on June 2, 1933, at a relative's home in Louisville. (This is Edward Filiatreau, another o 3 CONC f Raymond's son's who is a Benedictine Monk.) My husband was about 8 or 9 yrs old and playe 3 CONC d the violin. He was asked to bring it along to give a "concert" to the 40 or so Filiatreau 3 CONC s attending the ordination. Filiatreau 2 CONT 2 CONT Legend has it that Isaac Nazarre Filiatreau, the first of his surname to settle in Washingto 2 CONC n County, had been "stolen" as a child and packed off to Kentucky from Quebec. This romanti 2 CONC c tale has not been substantiated, but the little that is known about "Nazarre" (or Nazaire 2 CONC " or Nazarie") suggests that it is plausible. He told census officials he was born in Canad 2 CONC a on March 20, 1809. He told his children that their forebears had crossed the water from Al 2 CONC sace, France. His 1840 marriage, in Washington County, apparently was the first occasion t 2 CONC o warrant the recording of his name. 2 CONT Nazarre married Belinda Hayes (Brent), the daughter of John and Dina Hayes; she was 28 year 2 CONC s old and had a son, John Brent, b y a previous (1830) marriage to John G. Brent. She and Na 2 CONC zarre had seven children: William Thomas, born in 1841, Columbus Rucker (1842), Robert Peyto 2 CONC n (1844), Anna Jane (1846), Isabel (1848), Nazariah Augustine ("Nat") (1849) and James Frankl 2 CONC in Pierce (1853-the year Franklin Pierce became the nation's 14th president, presumably wit 2 CONC h Nazarre's backing). 2 CONT Some records refer to Nazarre's wife as "Malinda". Curiously, both names-Belinda and Malind 2 CONC a-reappear among the names given to the children of Columbus Rucker Filiatreau. 2 CONT Nazarre died on Dec. 30, 1898, at age 90, and was buried in St. Rose Cemetery. 2 CONT Two of his sons, Columbus Rucker ("Ruck") and William Thomas ("Bill"), joined the Union Arm 2 CONC y together in 1861. Bill was soon discharged because of illness, but Ruck saw action in a ho 2 CONC st of civil War battles. 2 CONT Early in the war, his Company K of the Tenth Kentucky Volunteer Infantry chased John Hunt Mo 2 CONC rgan away from the L&N Railroad. During its three-year existence, the Tenth Volunteers saw a 2 CONC ction at Mission Ridge, Jonesboro, Corinth, Rolling Fork, Hoover's Gap, Fairfield, Tullahoma 2 CONC , Compton's Creek, Rocky Face Ridge, Resaca, Chattahoochie River, Vining's Station, Pickett' 2 CONC s Mills, Courtland, Perryville, Lookout Mountain, Bunker Hill, Mills Spring, Little Gettysbur 2 CONC g, and Chickamauga; some units marched across Georgia with Gen. William Sherman. Of the 99 m 2 CONC en who joined Company K with the Filiatreau brothers, seven were killed in action and nine ot 2 CONC hers died while in uniform. 2 CONT Ruck, a battlefield nurse who drove a horse-drawn ambulance, was shot in the heel at Perryvi 2 CONC lle. He won several decorations and was discharged as a vice corporal in 1864. 2 CONT Ironically, when he died nearly 70 years later, the cause of death was a foot infection. I 2 CONC f it had to do with his old heel wound (one source has it that the fatal infection started i 2 CONC n a toe), he may have been the last casualty of the Civil War. 2 CONT Only a few stories of the War have survived in family lore: How Ruck and a handful of comrad 2 CONC es saved themselves hiding in the corn shocks while Morgan's cavalrymen passed so close by th 2 CONC ey could have reached out and patted their horses; how they slept on bar ground and often awo 2 CONC ke to find their hair frozen to the mud; how they cheated starvation by living on kernels o 2 CONC f corn picked out of horse manure. 2 CONT Ruck was born on June 7, August 4 or August 7, 1842, in the Manton section of Washington Cou 2 CONC nty. IN 1873, he married Josepha Alemany "Josie" Blandford, the seventh child of Thomas R. a 2 CONC nd Susan Caroline (Tennelly) Blandford. 2 CONT The record tells only that Josie was born on Jan.13, 1850, bore 10 children and died in 1916 2 CONC , of tuberculosis. Of the record, she is said to have been worm, wise, generous and resource 2 CONC ful. Her name evokes reverence in the family even today, 75 years after her death. 2 CONT (Ruck's brother Nat married Frances Blandford, Josie's sister. By the time of the 1870 Cens 2 CONC us, their older brother Bill had married a woman identified only as "Sary" and had fathered t 2 CONC wo daughters. The record is silent on the others.) 2 CONT Ruck prospered as a blacksmith, mule breeder and land trader in the years after the Civil Wa 2 CONC r. When he died, at age 90, he left each of his surviving three sons and six daughters a pri 2 CONC ncely sum - almost $10,000. 2 CONT One of his sons, Francis Xavier ("Zave") Filiatreau, had borrowed against and spent the bul 2 CONC k of his inheritance - about $7,000 of it - by the time of his father's death. He wasted lit 2 CONC tle time squandering the rest on a resort hotel in New Hope, whose future as a tourist trap h 2 CONC e had overestimated (to the unending displeasure of his humorless wife, the former Ida Mae Co 2 CONC tton). Eventually Zave moved his family to Louisville. 2 CONT Ruck's oldest son, Joseph Maurice, stayed at home, farming the family land on the banks of t 2 CONC he Beech Fork River not far from the Burg. "Maurice" and his wife, the former Fannie Logsdon 2 CONC , lived in a hilltop home that burned down after a gas explosion two decades ago. Nancy Malinda ("Aunt Nancy"), blinded in her youth by a m 2 CONC edication used to treat an eye infection, never married; she used her inheritance to live i 2 CONC n relative independence in various Catholic institutions. Mary Joseph ("Mary Jo") married Be 2 CONC nedict Clements of Lebanon. A seventh sister died just three days after her birth, to agin 2 CONC g parents, in 1895; she was given a touching, powerful name: Josie Rucker. 2 CONT Ruck died on June 2, 1933, at a relative's home in Louisville. In January, 1912, he procured for her certain medicine for the purpose of p 2 CONC roducing an abortion, but it failed to have the desired effect. In June, 1912, she delivere 2 CONC d of a child. In August 1912, a bastardy proceeding was instituted against Filiatreau in th 2 CONC e Marion county court, which resulted in a judgment against him of $75 and the costs, payabl 2 CONC e immediately, and $75 payable semiannually thereafter during the minority of the child. Dick Filiatreau answered, but failed to deny the charge of fraudulent transfer; his o 2 CONC nly plea being that he had on December 21, 1912, filed a petition in bankruptcy in the Unite 2 CONC d States Circuit Court of the Western District of Kentucky, and was therein adjudicated bankr 2 CONC upt; that the judgment sought to be enforced was proven in that proceeding as a claim agains 2 CONC t the estate in bankruptcy. He was present at the taking of the depositions, but he did no 2 CONC t testify. 2 CONT This appeal is prosecuted only as against William Filiatreau; the court, upon submission o 2 CONC f the cause, having adjudged that so much of the petition as sought a recovery against him sh 2 CONC ould be dismissed. 2 CONT 2 CONT It appears from the testimony that in the spring of `1912, and after he had learned that th 2 CONC e medicine he had procured had failed to produce the desired effect, Dick Filiatreau had on h 2 CONC is farm five mules, three jacks, and two jennets. He sold one of the mules to his uncle, C.R 2 CONC . Filiatreau, and the other to a man named Brent. AT the time of the birth of the child to E 2 CONC lizabeth Corbett, he had on his farm three mules, three jacks, and two jennets. Of the thre 2 CONC e mules, he still has one. The other two were thereafter taken to the farm of his father, Wi 2 CONC lliam Filiatreau, and William Filiatreau sold them to his brother, C.R. Filiatreau, for $260. 2 CONT William Filiatreau testified that these two mules were purchased by Dick Filiatreau when the 2 CONC y were weanlings, but that he furnished the money to pay for them. They were past three year 2 CONC s old, and had been reared by Dick Filiatreau; the father never having had either of them i 2 CONC n possession, nor exercised any act of ownership over them. The only explanation offered b 2 CONC y William Filiatreau as to why his son should have kept these mules so long, and then turne 2 CONC d them over to him just in time to evade the collection of the judgment here sought to be enf 2 CONC orced, is that these mules were smaller than other mules owned by him of the same age, and fo 2 CONC r that reason he wanted to keep them separate. This explanation is not satisfactory, nor i 2 CONC s the testimony clear as to the exact nature of the arrangement under which William Filiatrea 2 CONC u claimed to be the owner of these mules. The proof is decidedly insufficient to show that t 2 CONC hey were in fact his property. 2 CONT It appears from the evidence that these mules were not worth more than the price for which t 2 CONC hey were sold, and William Filiatreau must account for the $260 which he received for them. 2 CONT As to the three jacks and two jennets, it appears from the evidence that, after the birth o 2 CONC f the child to Elizabeth Corbett, William Filiatreau gave his son, Dick, a check for $200; an 2 CONC d it is claimed by William Filiatreau that he and his son, Dick, owned the three jacks and tw 2 CONC o jennets jointly, and that this check was given by him as the purchase price of his son's in 2 CONC terest. He says that Dick came to his house and stated that he was owing Henry Corbett a deb 2 CONC t of $200 and that he wanted to sell the "jennets, " in order to get the money to pay Corbett 2 CONC . "He said Henry was bound to have it, and wanted to know if I would take the jennets and gi 2 CONC ve him the money." And, without seeing them, William Filiatreau gave him the check "for his i 2 CONC nterest in the stock." The jennets were taken to the father. Two of the jacks are yet remai 2 CONC ning at Dick's. 2 CONT These animals had been reared by Dick Filiatreau, being the progeny of a jennet which his fa 2 CONC ther had once given him, and how it was that William Filiatreau came to have an interest in t 2 CONC hem amounting to the whole of their value except $200 is left to conjecture. One of these ja 2 CONC cks appeared to have died prior to the institution of this suit, and the record does not clea 2 CONC rly establish the value of the two remaining jacks and the two jennets; but the value of thes 2 CONC e two jacks and two jennets should be ascertained, and William Filiatreau must either accoun 2 CONC t therefor, or surrender the animals for sale herein, in satisfaction of the judgment sough 2 CONC t to be enforced. 2 CONT It appears from the evidence, however, though not very clearly, that the $200, which Willia 2 CONC m Filiatreau claims to have paid his son for this property, was applied to the satisfaction o 2 CONC f a claim which the son owed, and we think William Filiatreau should be credited with this am 2 CONC ount out of the proceeds of, or as a credit against, the value of the animals-the two jacks a 2 CONC nd two jennets. 2 CONT It is a wise and ancient rule that fraud is not to be presumed; that a presumption of innoce 2 CONC nce, and of good faith, and of fair dealing attends upon all the lawful transactions of all m 2 CONC en; and that upon him who asserts a charge of fraud is cast the burden of sustaining his accu 2 CONC sation. But, while fraud is not to be presumed, it is not required of him who charges it tha 2 CONC t he should enter into the secret councils of the perpetrators thereof and wrest therefrom th 2 CONC e direct evidence of their wrongdoing. Fraud may be inferred; circumstances may be shown o 2 CONC f such character as to create inferences making peremptory demand for explanation. 2 CONT In this case, the challenged transactions were had about the time of, or very shortly after 2 CONC , the birth of the child to Elizabeth Corbett and between Dick Filiatreau and William Filiatr 2 CONC eau, his father, who lived within 2 ư miles from each other. In the short space of a few day 2 CONC s, the mules, jacks, and jennets which had been wont to disport themselves over the grassy sw 2 CONC ards of Dick Filiatreau's farm had ceased to be his. William Filiatreau, his father, becam 2 CONC e their pretended owner. And these same mules, jacks, and jennets constituted practically al 2 CONC l the property of which R.O. Filiatreau had been possessed which could be subjected to his de 2 CONC bts; his farm being incumbered with liens amounting to a large percentage of its value. Suc 2 CONC h things as these occurring inter familia at such a time and under such circumstances as her 2 CONC e shown, call for more satisfactory explanations, for more candid testimony by the principals 2 CONC , and for a greater elaboration of the details of the transactions had between father and so 2 CONC n than was exhibited in this case. 2 CONT The maxim, "He who comes into equity must come with clean hands, " imposes itself alike upo 2 CONC n him who defends and upon him who prosecutes a suit in equity; and its requirements are no 2 CONC t satisfied by a fulfillment of the literal language of its demand. Be his hands spotless a 2 CONC s they may, he does not merit the protection of the chancellor who fails to make a full and f 2 CONC ree disclosure of all the fact relating to his claim. He was the grand-son of a Frenc 2 CONC h Soldier who came over to this Continent to fight in the French and Indian War. After the W 2 CONC ar he settled in Canada. Now I must get back to the person I started to tellyou about, Nazai 2 CONC re Filiatreau, my great-grand-father. In early manhood he was a gun-smith. He migrated to t 2 CONC he United States and traveled through New Orleans, St. Louis and finally settled in Kentucky 2 CONC . He married a native girl of Kentucky, Miss Hays. To this couple was born eight children 2 CONC , of whom Charles Rucker was the second youngest. He was born in 1843. He was very helpfu 2 CONC l in his father's shop when he wasn't in school. The school year at that time was very brief 2 CONC , lasting three months. He studied the usual curriculum, reading, writing and arithmetic, "t 2 CONC ought to the tune of a hickory stick". The students sat on benches made of split logs, lon 2 CONC g enough for three or four persons. Their desks were likewise made of log. The writing mate 2 CONC rial consisted of slate and pencils. Charles lived two or three miles from the school and ha 2 CONC d to walk. He left easrly in the morning, carried his lunch and arrived home in the evenin 2 CONC g in time for dinner. 2 CONT 2 CONT One summer his father decided to take the family to Illinois in a covered wagon. Winter se 2 CONC t in before they reached their destination. The raods were muddy and hard to travel and th 2 CONC e weather was cold. Some of the family became ill and the youngest boy died. At that time t 2 CONC hey were in Vincennes, Indiana, the boy was buried there. A warm spot lingers in the heart o 2 CONC f what is now an old man, at the mention of Vincennes. When Illinois was reached, they remai 2 CONC ned there a few months, then returned to Kentucky. The new state was not as satisfactory a 2 CONC s they thought it might be. 2 CONT 2 CONT Within a few years the Civil War broke out. Charles was nineteen years old and he entered th 2 CONC e army. He was in service three years, in the Northern ranks. It is very interesting to hea 2 CONC r him tell of his adventures. Food was scarce and cloting scanty. Many times when only a fe 2 CONC w moments could be spared, the men ate their ration of meat raw- relishing it immensely, espe 2 CONC cially if they were hungry. At night a bed was built out of brush and broken limbs from tree 2 CONC s, with a blanket spread over this, if any blanket was available. At one time when the arm 2 CONC y was near the capitol, Charles saw Lincoln. He still speaks of the kind and benevolent fac 2 CONC e Lincoln had. While he was away, things were4 not so peaceful at home. Men of the south o 2 CONC r the enemy formed troops of their own and invaded homes, robbed and killed as they liked 2 CONC . A troop of these men entered the home of Charles's folks and rode through the house on hor 2 CONC ses. They were after one man of the family whom they thought knew a secret they wished to kn 2 CONC ow. Everyone was so frightened they hid in every conceivable place. The troop found one ma 2 CONC n and told himn if he did not tell where his comrade was, it meant his life. A fight was imm 2 CONC ediately on hand, in which the man was fatally injured. However, they never found their desi 2 CONC red hostage. They did not feel that enough damage had been performed, so they burned the bar 2 CONC n, after taking all of the desired articles. 2 CONT 2 CONT In a few years, the wasr was over and Charles was home again. In a few years more he marrie 2 CONC d Josephine Blandford, a young lady of the same vicinity. Josephine Blandford's mother and f 2 CONC ather came from Maryland. Now that Charles and Josephine were married a new branch of life wa 2 CONC s started. Their first child, precious child to them and later to me, was a bouncing baby bo 2 CONC y, Ramond Nazaire. HBe was named after his grandfather. The bed on which RAymond was born h 2 CONC as an interesting history, as to births. Raymong's mother and her father were all born on th 2 CONC is bed, in the same room and in this same house. The house is located in WAshington County 2 CONC , near Bardstown, Kentucky. Raymond's father still lives in thsi old, old house today and th 2 CONC at bed is still being used. It is a big four poster bed made of walnut. Following this chil 2 CONC d, respectively came two more boys and six girls, all of whom are living today. At this tim 2 CONC e Charles was a poor farmer, struggling, saving and economizing to rear his children. The fi 2 CONC rst boy raymond became a Medical Doctor. He received his training at Louisville Medical Scho 2 CONC ol and later received his degree from Marion College, St. Louis, what is now St. Louis Univer 2 CONC sity. Two fo the daughters are now teachers, one in Nebraska and the other one in West Virgi 2 CONC nia. The others married and now live in Kentucky. 2 CONT 2 CONT As a boy Raymond helped his father on the farm. He often drove horses, or cattle to Bardstow 2 CONC n to market. One night as he was riding home from Bardstown, in a fierce rain storm, his hor 2 CONC ses gave out. He was near a home, so he stopped there to ask assistance. They asked him t 2 CONC o remain all night and take one of their horses in the morning. He did this. Even though the 2 CONC y were strangers to him it was safe for him to do this. It is just a little proof that peopl 2 CONC e were honest and held confidence in a fellowman. It seems that times have changed. 2 CONT 2 CONT Toll gates were very common those days. Raymond was going on an errand for his father and ha 2 CONC d to pass one of the toll gates. He happened to have no money and the gatekeeper realizing t 2 CONC his began a conversation with the lad and among other things, asked him whose little boy he w 2 CONC as. "I's pap's little boy, " he said and rode on. Children have been able to do many thing 2 CONC s other people are ostracized for. 2 CONT 2 CONT Raymond's grandfather was still living at this time. When Raymond was fifteen years old he a 2 CONC nd his grandfather went to Canada. Nazaire had not been back since he left about forty year 2 CONC s previous. This was quite an adventure for the boys, both young and old. For traveling faci 2 CONC lities had changed. Trains were in use. They stopped at Niagara Falls. Tehy went up the ri 2 CONC ver through the cascades, which no one should miss if they visit the falls. In a few days th 2 CONC e city of Nazaire's childhood was reached. The city had changed and he did not know how to f 2 CONC ind his friends. After finding information he finally located the humble little home of hi 2 CONC s sistwer. Knocking at the door he introduced himself. She did not belive him adn said tha 2 CONC t Nazaire had been dead for years. When he convinced her that she was mistaken they went i 2 CONC n and enjoyed a delicious French meal. French was the only language spoken and Raymond did n 2 CONC ot know the tongue. He heard them say what sounded like, "Why didn't you come before, " H 2 CONC e asked his grandfather what that meant. He replied, "Eat Plentifully." They did without be 2 CONC ing told. 2 CONT 2 CONT Let us turn our attention a few years later, after Raymond had received his degree in medicin 2 CONC e. He returned home, but it was impossible for him to practice there. Like a young fellow h 2 CONC e was very discouraged. He had all of this educatiuon, now what was he going to do with it 2 CONC . ONe thing certain he couldn't remain there. His mother's brother, who was a doctor wante 2 CONC d him to come to Louisville with him. This he did. 2 CONT 2 CONT He heard of an offer in a country town called Knottsville, Kentucky in Davies County. It see 2 CONC med promising to him so he settled there. He had a little office and rode horse back throug 2 CONC h the country on his calls. Since the doctor who had resided there for many years was very o 2 CONC ld, the youth received most all the practice. Now a man can't live through all the hardship 2 CONC s of getting established without a little romance to spur him on. A very sweet maiden name 2 CONC d Genevieve Clements lived in the town and they became acquainted. Her mother was propriatres 2 CONC s of a hotel and her father was manager of a General Mercantile Store. 2 CONT 2 CONT Genevieve's mother, before marriage was a Montgomery. Appolinia was her given name. Miss Ap 2 CONC polinia Montgomery's mother was an Aud, Miss Clotilda Aud's mother was a Blandford, and Mis 2 CONC s Blandford's mother was a Cooms. It might appear to my readers, that the family name Blandf 2 CONC ord, being in both the Clement's branch and the Filiatreau's, that there might be some relati 2 CONC onship. It was traced and no kinship was found. Zachery and Appolinia were brother ans sist 2 CONC er. Appolinia was the youngest and Zachery was very fond of her. He was a very adventurous b 2 CONC oy and man. During the Gold Rush in Califorina he and some other people of the vicinity, Ken 2 CONC tucky started out. After many weeks of tedius traveling and combat with Indians they reache 2 CONC d California. He setytled in the southern part of the state in San Diego. He became a mos 2 CONC t eminent lawyer. He was considered the most brilliant lawyer in California and the uglies 2 CONC t man in the state. He held many public offices, among one of the most important was the off 2 CONC ice of Attorney General of the United States, during Cleveland's Administration. About the s 2 CONC ame time, there was a very wealthy family who lived in St. Louis, a mother and her two daught 2 CONC ers. One was named Ellen, the other name has been forgotten. This family with other peopl 2 CONC e started out also for the Gold State. Just before they left Ellen had made her debut in Soc 2 CONC iety. One of themain things that she packed was her gorgeous evening frock. I don't know whe 2 CONC re she thought she could wear it out in the wilderness. They traveled like anyone else, by co 2 CONC vered wagons. Many horses, cattle and food supplies were taken, besides the private article 2 CONC s of each individual. The journey was lo9ng and tiresome, lasting nine months. They travele 2 CONC d three or four days then rested two. Many times they had to fight the Indians, from robbgin 2 CONC g or killing them. After what seemed a long time, they reached Salt Lake City. An old Morma 2 CONC n woman became attached to Ellen and wanted her to stay and marry her son. But Ellen refuse 2 CONC d and said they were leaving the next morning. This old woman told Ellen if they were intend 2 CONC ing to go the southern route not to, for the Indians were waiting for travelers and they migh 2 CONC t be killed. Ellen thanked her for the information and informed her mother. She suggested t 2 CONC he plan to the troop. Some of the men said they were going by the southern route, as they ha 2 CONC d planned. But the rest of these overland travelers went north. The first crew were never he 2 CONC ard of after they parted. They were probably killed by the Indians. The people who wnet nor 2 CONC th were trudging along when before their eyes was a high wall of stone. It was a mountain 2 CONC . There was no possible way to go over, around or under it, but they must turn back. Previo 2 CONC us to this they had come to a fork in the raod. Ellen's mother wanted to take one road and t 2 CONC he men wanted to take the other. The men won out and this is what it led up to. Their food s 2 CONC upply was almost exhausted, the ir horses were dying slowly one by one, and they were almos 2 CONC t hopeless. The men sat down and cried. Ellen's mother told them if they had followed her a 2 CONC dvice this would not have happened. Now htey must retrace their steps miles and miles. Perh 2 CONC aps then all their food would be gone. However this they did, rather than sit there and die 2 CONC . Each member discarded some garment or article on their person in order to lighten their bu 2 CONC rden. Ellen had only two garments left, what she had on and her silk evening dress. She cou 2 CONC ld not decide which one to keep. She put the evening dress on and paraded into the town Oakl 2 CONC and. As time went on Oakland, California grew and became well populated. Ellen's mother own 2 CONC ed nearly half of the land of the town and was one of the first settlers who really started t 2 CONC he town. 2 CONT 2 CONT Zachery Montgomery met Ellen and as the story goes, he married her. They had a son John, wh 2 CONC o as a child was very fond of birds. He liked to watch them fly. One day he told his fathe 2 CONC r that someday people would fly just like those birds. Of course his father laughed at him a 2 CONC s anyone would. As he grew up he was very fond of Chemistry and science in general. When h 2 CONC e was not busily engaged in his laboratory he was workijng on his aeroplane. He secured a pa 2 CONC tent for his machine and went up in it for the first time as a test flight. It flew. Howeve 2 CONC r before going very far it crached. John was unconscious and died in a short time. His mech 2 CONC anic said he belived that John was so utterly overtaken with the fact that it really flew tha 2 CONC t he lost control of it and himself. That evidently was the cause of the disaster. His pate 2 CONC nt was stolen by the Wright Brothes and they are feted today as the original makers of the fi 2 CONC rst aeroplane. The defective business was carried on this way: Both of the men were in confi 2 CONC dence with the sdame man, unknowingly however. He gave the Wright Brothers the material fo 2 CONC r the makeup fo the machine. Today the case is still in court. Whether it will ever be right 2 CONC ed is yet to bew seen. 2 CONT 2 CONT All of this may sound like a fictitious story, but all of it is quite true. It can be verifi 2 CONC ed by the fact that Zachery's sister Appolinia had a daughter, Lilly Mae, who visited Ellen t 2 CONC he mother of John, a few years ago. It was all told to her from their very lips. 2 CONT 2 CONT I must tell you now about Appolinia. She married Charles Clements and ten children were sen 2 CONC t to them. Two girls and one boy became a teacher. One girl became a Podiatrist, a foot spe 2 CONC cialist, who lives in Indianapolis. The others who are living are either married or single 2 CONC . Tehre are only five now living. Their parents are also deceased. The youngest child Gene 2 CONC vieve, of course the nearest and dearest to them and later to me. 2 CONT 2 CONT Now recalling the young doctor who was mentioned, was now a prospering physician of the town 2 CONC .
